An amicus brief was presented to the US Supreme Court by Michael McGovern on March 21,2013, for the case Dan's City Used Auto v. Pelkey:

In the "Pelkey" case, the United States Supreme Court held: Section 14501 (c) (1) does NOT preempt state law claims stemming from the storage and disposal of a towed vehicle.

This is basically the same as it has always been...towers have to comply with state law for storage, processing and disposal of the vehicles they tow.  The law may be a little different from state to state, but Federal law does NOT preempt it.
